Personal injury litigation in Maryland — the process

When a fair settlement cannot be obtained, Engel & Engel, P.A. can move quickly in filing your personal injury lawsuit. The general sequence of steps in a personal injury lawsuit includes:

  • Complaint and answer. The complaint is the document filed which states the allegations and damages you have sustained. Once filed, the complaint is served on the defendants. In-state defendants have 20 days to respond and out-of- state defendants have 60 days to respond.
  • Discovery. Discovery is the process by which the Baltimore personal injury lawyer obtains information, testimony, documents and other evidence from any parties with relevant information. The discovery phase can generally take six months to a year. Information for discovery is generally obtained through:
    • Document requests
    • Interrogatories
    • Depositions
  • Motions. Defendants may file motions to get the court to dismiss some or all of your asserted claims. Motions can be responded to in writing or sometimes a hearing is held by the judge to hear arguments by the parties. After motions are heard and ruled upon, your case is generally ready to go to trial.
  • Mediation. The parties may choose to participate in mediation at any time during the litigation. During mediation the parties and their attorneys meet with a mediator and discuss settlement options. If a settlement cannot be reached, litigation continues. Mediations are non-binding.
  • Trial. Depending on circumstances and court dockets, trial dates can be scheduled quickly or take considerable time. However, generally it takes 12 to 18 months from filing to the start of trial.
